SWTCH Home Charging Program - Terms and Conditions

Welcome to the SWTCH Home Charging Program (the “Program”), offered by SWTCH Energy Inc. (“SWTCH,” “we,” “us”). These Terms and Conditions (the “Agreement”) govern your participation in the Program.
This Agreement incorporates by reference the SWTCH Privacy Policy.
By placing an order and participating in this Program, you (“Customer,” “you”) agree to be bound by this Agreement.
1. Definitions
- “SWTCH Home App” refers to the official SWTCH mobile application used to connect the charger to the SWTCH server, monitor charging, track energy usage, and view earnings.
- “Incentives” refers to any federal, provincial, municipal, or utility-sponsored rebates, incentives, or tax credits related to the purchase and/or installation of an EV charger.
2. Program Eligibility
To participate in the Program, you must:
- Be a resident of Canada.
- Own or have the legal right to install an EV charger at your specified residential property address.
- Create and maintain a SWTCH account in good standing, register your EV charger in the SWTCH Home App upon installation, and maintain internet connectivity to your EV charger.
3. Program Options
You may choose one of the two following options to acquire an EV Charger:
3.1. Free EVL001 Joint Tech EV Charger
- Acquisition: A residential property may receive one (1) Joint Tech EVL001 EV charger from the SWTCH Home Charging Program at no upfront hardware cost.
- Security Deposit: You must pay a refundable security deposit of $300 CAD (the “Deposit”). The Deposit is held as security for your fulfillment of Program obligations, primarily the assignment of Incentives as detailed in Section 8.
- Deposit Refund: The Deposit will be refunded to you in full once your Charger has delivered a cumulative total of 1,500 kWh of energy, as measured by our systems and displayed in the SWTCH Home App. There is no time limit to reach this threshold. Once the threshold has been reached, your deposit will be credited back to your original payment method in 3-5 business days.
3.2. Outright Purchase of EVL001 Joint Tech EV Chargers
- Acquisition: A residential property may purchase any number of EVL001 Joint Tech EV chargers from the SWTCH Home Charging Program store at the listed retail price of $499 CAD plus applicable taxes.
- Incentives: You retain the right to apply for and receive any and all Incentives for which you are eligible. SWTCH has no claim to these Incentives.
4. Title and Ownership of the Charger
Title and ownership of the Charger transfer to you upon successful delivery, regardless of whether you selected the Free Charger Program or the Outright Purchase Program. The Charger is your property.
5. Ordering, Shipping, and Returns
- Shipping Costs: You are responsible for all shipping costs as calculated during checkout.
- Return Policy & Restocking Fee: Chargers may be returned within thirty (30) days of delivery. To be eligible for a return, the charger must be in its original packaging, unused, and in the same condition that you received it. All returns are subject to a $75 CAD Restocking Fee. You are responsible for all costs associated with return shipping. The Restocking Fee and the original shipping charges are non-refundable and will be deducted from your refund amount.
- Customer Responsibility for Compatibility: It is your sole responsibility to consult with a licensed electrician to confirm that your property’s electrical system and Wi-Fi signal strength at the installation site are sufficient prior to placing your order.
6. Installation
- You are responsible for all costs and arrangements for the installation of the Charger by a licensed electrician in compliance with all applicable electrical safety codes.
7. Connectivity, Data Collection, and Earnings
This section applies to all participants in the Program.
- Mandatory Connectivity: To participate in the Program and be eligible for earnings and/or a Deposit refund, your Charger must be registered in the SWTCH Home App and remain connected to a stable Wi-Fi network with an internet connection.
- Data Collection: You acknowledge and agree that SWTCH will collect energy usage data from your Charger. This data is used to:
- Calculate your earnings.
- Track your progress toward the 1,500 kWh Deposit refund threshold (if applicable).
- Generate and aggregate any applicable carbon credits under programs like Canada’s Clean Fuel Regulations.

- Earnings: For every kWh of energy your Charger delivers, you will earn either $0.03 CAD (for participants who choose the free EV charger option) or $0.05 CAD (for participants who buy the EV charger outright). These earnings will be displayed in your SWTCH Home App.
- Earnings Payout: Once your earnings balance reaches $100 CAD, a payout via direct deposit through the SWTCH Home App will be processed. Payouts are processed within 15 business days.
- Consequences of Lost Connection (All Participants): If your Charger loses its Wi-Fi connection, it will continue to function as a standard charger and will store your charging session data locally. Once the internet connection is restored, the Charger will automatically sync this stored data with our systems. Your usage statistics and earnings for those offline sessions will then be calculated and reflected in the SWTCH Home App. A continuous connection is required to ensure this data is received in a timely manner.
- Consequences of Lost Connection (Free Charger Program Participants Only): If your Charger remains offline for a consecutive period of 180 days, you will be in breach of this Agreement, and your $300 deposit and any earnings generated will be forfeited and you will be removed from the program.
- Software and Firmware Updates: You acknowledge and agree that SWTCH may, from time to time, remotely update the software or firmware on your Charger without prior notice. These updates are necessary to ensure security, improve functionality, and maintain the Charger's compatibility with the Program. You agree to maintain the Charger's internet connection to receive these essential updates.
8. Rebate Assignment (Applicable to Free Charger Program Only)
- Assignment: By selecting the Free Charger Program, you irrevocably assign all rights to any and all Incentives to SWTCH Energy Inc. You agree to act as our agent to secure these Incentives on our behalf.
- Customer Cooperation: If an Incentive program sends payment directly to you, you agree to remit the full amount to SWTCH by mailing a cheque to our head office (7 Queen Elizabeth Blvd, Toronto) within 30 days of your receipt of the funds.
- Non-Compliance: Failure to remit an Incentive payment to SWTCH constitutes a material breach and will result in the forfeiture of your $300 Deposit and immediate termination from the Program.
9. Relocation (Moving)
- Moving Within Canada: You may move and take your Charger with you to another location within Canada. Your progress toward the 1,500 kWh goal will not reset. You must inform us of your new address by updating your address in the SWTCH Home App.
- Moving Outside Canada: If you move outside of Canada before reaching the 1,500 kWh threshold (if applicable), your $300 Deposit will be forfeited and you will stop earning for your usage.
10. Sale of Property and Non-Transferability of Participation
Participation in the Program is non-transferable and is tied to you, the original customer, and your SWTCH account.
If you sell your property, you have two options regarding the Charger:
1. Leave the Charger: You may leave the Charger for the new owner. However, your participation in the Program will be terminated. If you were in the Free Charger Program, your participation will be cancelled as per Section 12.1 (which may involve returning the Charger or forfeiting your deposit).
2. Take the Charger: You may uninstall the Charger and move it to your new residence within Canada, as described in Section 9 (Relocation).
The new property owner cannot take over your account, your earnings balance, or your progress toward the 1,500 kWh deposit refund threshold.
However, if you leave the Charger at the property, the new property owner is welcome to join the Program. They may apply as a new customer, register the existing charger under their new account, and will be eligible to participate under the Outright Purchase Program terms (earning $0.05 CAD per kWh).
11. Warranty, Damage, and Misuse
The following warranty terms apply to all participants.
- Manufacturer Warranty: Your Charger includes a two (2) year limited warranty provided by the manufacturer, Joint Tech.
- Warranty Process: If you experience a problem with your Charger, contact SWTCH customer support at homesupport@swtchenergy.com. If we determine the Charger is faulty due to a manufacturing defect within the 2-year warranty period, we will provide a replacement unit and will cover the cost of shipping.
- Post-Warranty: After the 2-year warranty period expires, you are responsible for the repair or replacement of the Charger at your own cost.
12. Program Cancellation and Termination
12.1 Cancellation by Customer (Free Charger Program only): If you wish to cancel your participation in the program after the 30 day mark and be eligible for a partial refund of your Deposit and get paid for what you have earned by charging, you must return the Charger to SWTCH at your expense and a restocking fee of $75 will be deducted from your deposit, If the Charger is damaged beyond normal wear and tear, we may deduct repair costs from your refund. Payment to your bank account and the remaining amount of your deposit will be paid within 7 business days. To cancel, email homesupport@swtchenergy.com.
12.2. Termination for Breach or Inactivity: SWTCH may terminate your participation in the Program if you commit a material breach of this Agreement (e.g. prolonged offline status or failure to remit an Incentive payment if applicable). SWTCH also reserves the right to terminate your participation due to inactivity, as defined in Section 7. In the event of termination for breach or inactivity, your $300 Deposit and any accrued earnings will be forfeited.
12.3. Termination Due to Carbon Credit Program Cancellation: SWTCH's ability to offer earnings is contingent on the existence and our participation in government-sponsored carbon credit programs (e.g., Canada’s Clean Fuel Regulations). If these programs are altered, cancelled, or if SWTCH is no longer eligible to participate such that we cannot generate revenue from your charging data, SWTCH reserves the right to terminate the earnings portion of the Program for all participants.
In such an event, the following will occur:
1. Notification: All active participants will be notified via email that the earnings program is ending.
2. Earnings Cease: Effective on the date specified in the notification, participants will no longer accrue new earnings from charging sessions.
3. Final Earnings Payout: SWTCH will process a final payout of all accrued earnings in your account. This payout will be made regardless of whether the $100 payout threshold has been met.
4. Pro-rated Deposit Refund: If you participated in the Free Charger Program and have not yet reached the 1,500 kWh refund threshold, you will receive a pro-rated refund of your $300 Deposit. The refund will be calculated based on the total energy you have delivered.
- Formula: (Total kWh Charged / 1,500 kWh) * $300 = Refund Amount
- Example: If you have charged 1,000 kWh at the time of program termination, you would receive a refund of $100 (1000 ÷ 3000 × $300), in addition to your final earnings payout.
13. Limitation of Liability & Indemnification
- Limitation of Liability: To the maximum extent permitted by law, SWTCH shall not be liable for any indirect, incidental, or consequential damages, malfunctions, or safety hazards arising from the installation or use of the Charger. It is your sole responsibility to ensure the installation is performed in compliance with manufacturer recommendations and in a safe manner by a qualified professional. Our total liability under this Agreement shall not exceed the amount you have paid to us.
- Indemnity: You agree to indemnify and hold harmless SWTCH from any claims or losses arising from a) your breach of this Agreement, b) your violation of any applicable laws, c) your negligence or wilful misconduct, d) your improper use of the Charger, or e) any claims brought by third parties arising from your participating in the Program or your use of the Charger
14. General Provisions
- Governing Law: This Agreement shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
- Dispute Resolution: In the event of a dispute arising from this Agreement, you agree to first attempt to resolve the matter by contacting our customer support team at homesupport@swtchenergy.com. If the dispute cannot be resolved informally, both parties agree to pursue resolution through binding arbitration under the laws of the Province of Ontario before resorting to litigation.
- Force Majeure: Neither party shall be held liable for any failure to perform its obligations under this Agreement if such failure is caused by events beyond its reasonable control, including but not limited to acts of God, war, terrorism, natural disasters, or widespread internet or power outages.
- Entire Agreement: This Agreement, along with the Privacy Policy, constitutes the entire agreement between you and SWTCH concerning the SWTCH Home Charging Program.
